Did Warren Kinsella Help Obama Campaign Break Federal Donation Law?

Here’s the section of the FEC Website:

The Act prohibits knowingly soliciting, accepting or receiving contributions or donations from foreign nationals.  In this context, “knowingly” means that a person:

• Has actual knowledge that the funds solicited, accepted, or received are from a foreign national;
• Is aware of facts that would lead a reasonable person to believe that the funds solicited, accepted, or received are likely to be from a foreign national;
• Is aware of facts that would lead a reasonable person to inquire whether the source of the funds solicited, accepted or received is a foreign national.
  11 CFR 110.20(a)(4)(i), (ii) and (iii).

Based on Warren Kinsella’s own blog post it seems the “two nice Democratic people” had actual knowledge that Warren was a foreign national.

What has to be done? From the Federal Election Commission website:

When a federal political committee (a committee active in federal elections) receives a contribution it believes may be from a foreign national, it must:

• Return the contribution to the donor without depositing it; or
• Deposit the contribution and take steps to determine its legality, as described below.

 Taken from Obama’s webstore:

Any purchase is considered a federal contribution to Obama Victory Fund. If you have already contributed the maximum amount under federal law or are otherwise ineligible to contribute under the federal rules, you may still purchase Obama merchandise by visiting the purchase store, XXXXXXXXXXXXX

Was Warren at an official campaign headquarters or some “purchase” store? Inquiring minds want to know.

Update One: Speaking of foreign campaign donations.  Top money bundler arrested in Nigeria. Coupled with ACORN voter registration drives I predict around 400 million voters this year.

Nigerian anti-graft investigators have seized money raised by the head of the Nigerian Stock Exchange to support US presidential candidate Barack Obama.

The Economic and Financial Crimes Commission said it would give the money back to those who attended a gala dinner in Lagos last month.

The EFCC said it had seized 74m naira ($630,000, £314,000), but said no Nigerian laws had been broken.

US political parties are not allowed to receive contributions from abroad.

“There is not one Nigerian who doesn’t have a relative or friend in America. Our aim was to encourage those people to tell their family who have the right to vote in America to vote for Obama.” —-BBC, Uk

Evans has bundled between $50,000 and $100,000 for Obama as well as contributing the maximum $2300 to Obama’s presidential primary campaign. She co-hosted Obama’s breakout Hollywood fundraiser at the start of his campaign in February 2007.  —- Gateway Pundit

As a bundler, Evans has been given perks that include regular briefings by top campaign staffers on policy and private meetings with Obama and his vice presidential candidate Joe Biden.
